Lawyer for Kelly Altenburg: My Client Wasn't in the Room
An attorney for the embattled special education teacher says she wasn't present for the remarks captured on Stuart Chaifetz's secret audio recording.
According to her attorney, Matthew Wieliczko, Kelly Altenburg was not present in her classroom when the worst of the remarks were allegedly made to 10-year-old Akian Chaifetz in her special education classroom at the Horace Mann School in Cherry Hill.
At a press conference Friday, Wieliczko told the media that Altenburg was in a meeting at the time, and that she "does not condone the words and the conduct" of the people whose voices were captured on the recording.
"This language was not used by her or in her presence, or at her direction," he said.
Wieliczko went on to say that Altenburg "[n]either said [those words n]or was in the presence of others" heard on the audio footage captured by Stuart Chaifetz, Akian's father, who slipped a digital recorder into his son's pocket after he was unable to reconcile reports of the boy acting out in class with his docile behavior elsewhere.
The case has caused a national stir since Stuart Chaifetz took to YouTube to complain that Altenburg, as the responsible teacher, should be removed from her position in the district.
Wieliczko went on to say that the media attention has affected not only Altenburg but an unlucky 23-year-old Minnesota college student of the same name, whose likeness has been posted online in mistaken reference to the Cherry Hill teacher.
(In a twist of fate, the younger Kelly Altenburg is studying to become a special education teacher.)
"Without defining the word 'threatened,' we're concerned about Mrs. Altenburg," Wieliczko said.
According to a statement released by the Cherry Hill school district today, Altenburg was placed on paid leave pending a complete investigation of the matter.
"The Administration, with the assistance of counsel, is continuing to investigate what occurred in the classroom in question," the statement reads. "Since the evidence presented is audio only, it is imperative that the improper conduct identified on the recording is correctly identified to the person(s) who committed the conduct.
"New Jersey law provides protection to tenured employees against immediate dismissal...While we understand the public’s desire for more information and action, we hope as well that you will understand we are legally constrained in the amount of information we can release and any immediate action we can take."

This boy drove his mother and the teacher to drink. That is very common with autistic children They often will cause parents and teachers to take pills get divorce and alcoholism . Ask any parent of an autistic child if they medicate themselves or drink heavily.

Mike, my brother in-law is father to a 24 year od autistic daughter. He just recently lost his wife who passed away at 49. Neither of them are heavy drinkers, or take pills. as a matter of fact he does not drink at all. I think you are painting with a VERY wide brush and should be careful with how you group people. If people drink or medicate themselves it likely out of self pity more then dealing with their autisic child. Those that embrace the child find it rewarding and find your comments offensive. My neice is a wonderful human being and I just recently learned more about her then ever as my wife has taken a very active role in her life. I suggest you try to learn about these kids. The love they give back is wonderful, and is what is helping my brother in-law get throught the tragic loss of his wife.

When did the protection of free speech become the protection of worthless speech? If you were there, you have a responsibility to report this to the proper authorities and testify in court. If it's a FACT that she was in conference when the incident occurred, then the individual responsible should be sought and every effort to do so directed methodically in THAT direction instead of linching the first person we see...who may be innocent of wrong-doing.

Lets talk about FACTS. If the recording was made in the class room by a digital recorder the sound quality should be very high when plaid back on a good system.
Should not be to hard for the school heads to recognize who it was. Would you recognize a fellow employee's voice? Also how do we know where the recording made?

Whether she was present during some of that verbal abuse is irrelevant, considering that disgusting behavior is CLEARLY the norm in her classroom.
Maybe read the articles and find out this was in no way "linching the first person". The man wanted to make sure that at the very least, all present would be at the least suspended. The school district's website stated just that, but it was later found she was actively teaching in the local high school.
Regardless of how much noise there is in the audio recording, people have uniquely identifiable formant spectra--not that difficult to verify accurately.
Given that classrooms take attendance and that some aids have been verified, it's not difficult to identify the location and whereabouts of the child.

If the people heard on the tape were school employees, they should have been thoroughly vetted before being hired. To hold a teacher who was out of the classroom responsible for the actions/words of other employees is outrageous. Teachers are cautioned against leaving students unattended, but that does not appear to be the case here.

Legitimate how? Some have already owned up to what they've said there. Or do you mean legitimate as in they should have been made aware that their statements in a public place were, well, PUBLIC???
Her lawyer can say ANYTHING he wants to, that lady lives in a world of poop now, and while she may not get fired, have financial or criminal penalties brought against her, she can now live forever in the bed that she made in tolerating that kind of cultivated behavior in her classroom.
I'm sure she can work at a gas station, somewhere, in near anonymity...

@Mark you never know. One of the murderers that the film Heavenly Creatures was based on went out of the spotlight until everything boiled down... Then she changed her name, moved countries, and became a successful murder mystery author. It wasn't until the movie came out decades later, that people linked her with her past.

u sound like a teacher...but until all the facts are presented, the child need to be protected, after all, the child does go to school to learn, right? as far as your statement to remove the child from school, not an option! teachers and aids are there to work with the children, not bully them in any manner. the persons in question should be FIRED when the investigation has concluded!

Oh yes, the response to a verbally abusive group of silly, mean women is "even though the law dictates all children should have equal access to education, I'm just pulling my kid out", not "let's protect ALL children from people like this".
To state that the appalling behavior WASN'T the norm for her classroom is a bit of a stretch, don't you think? I assume at some point she was actually inside her own class.

listening to that tape gave me a headache. I feel sorry for the teachers who have to deal with those spoiled brats everyday. The parents can't wait to drop off the kids at school. The teachers are expected to do miracles with kids who can't or won't listen to simple instructions. NO THANKS even $350k

To the person who says they were in the room and heard this person make the comments - you should contact the authorities and tell them what you know. You need to do the right thing by this child and tell the truth!
This is a sad situation - for the children in that classroom! It sounded to me like whoever it was on the audio was very sadistic and took pleasure at being mean. A very sick individual. Whoever it was - and I agree, they should be able to figure out whose voice it was - needs to have criminal charges AS WELL AS lose their job!

I have a child that was bullied by his teacher the school did the same thing Transfer. Im so sick of these so called teachers that say they care. I hope he sue the you know what out her. You need to lighten up . Those teachers love the kids. Did you listen to the whole 6 hours of tape ? Some autistic kids need to be scolded for misbehavior. If it was a girl I would say it was harsh, but for a 10 year old boy he needs to learn to follow institutions. Listen to the whole 6 hours before your witch hunt. They have skills and were just doing what they thought was right for the behavior of the special child.

She had to be in the classroom at somepoint in the 6 hours of recording time and she is the teacher and should have done the right thing. It is obvious that everyone in that room was culpable to the problems It is an attitude that these children are not important due to thier disabilities. DISGUSTING!!!!!!!!!!!!!

I just learned the boy was a terror in the classroom. He scratched and hit Jody and Kelly and threw chairs at them. He would bite them and throw temper tantrums. She has bruises and bites from him. He would not follow instructions. He would not stop screaming and yelling. They used to plead with him to stop throwing things at them. But the boy would only get more aggressive turning over tables and breaking anything he could grab. This is why the teachers tried to confront with him with harsh words. Listen to the whole 6 hours , I feel sorry for the teachers getting so much hate from you JEN and the angry child.

I'll bet those teachers started out being nice friendly young ladies. But being around needy kids all day, starts to wear and tear at you. My friends wife takes Jack , he is an autistic kid , to grandma's house at 3:00 every day and starts drinking. The Crying , screaming kid who cannot listen to instructions will drive you to frustration and cause you to go insane. if you listen to the tape carefully the kid was poking or hitting the teacher. She was frustrated and tired and the kid was just whining and whining. This day after day after day wears on a lady. The father is lying about his child being docile all the time. All autistic kids are Colic. The father babied the kid and held him when he cried for hours and hours for no reason. All teachers need breaks from being around needy children all day. The best of them will eventually break down and get upset. So don't be too hard on these woman, until you have to deal with these needy kids every day and night. They wake up screaming and yelling and crying every day and night. They will hit you pull your hair and bite for no reason.
They also will sit and stare and not listen to you . Until you try to deal with these kids don't be too critical of the teachers being frustrated to the point of verbal abuse

if you feel like you are on the point of insanity maybe its time to find another career. if the job isnt right and you cant handel it; change it.
as for your friends drinking problem.. totaly on them. you can find outlets if you are frustrated and need to take your mind off things.
And not to be rude, but please rethink what you are going to generalize with disordered children. this is not directed specifically at you because i have seen a wide number of ppl use the term "all autistic kids," every "normal" child is different; so why cant autistic kids be different, even if by a little from eachother? thats why Autism is refered to on a SPECTRUM isnt it?
and why would you bash the father for not wanting to see his child upset? if your child was sick and crying and you couldnt help them it would tear you up inside to see him/her soo frustrated and distraught. *if your a human being with emotions that is* if you are too harsh on a kid you are looked at as a jerk and awful parent. but you try and make your child too content and your a push over. everyone handles their child differently. never try and tell a parent they are doing it wrong unless the child is legitemently in danger.
and that break that teachers need? its called wekends, summer, winter, and spring vacation. yeah believe it or not the kids and teachers both need breaks from eachother! and this is how it was handled

I just listened to the tape again. The father has a temper. His wife left because she could not handle him or the colic child. that is why he has custody. The kid was not following the teachers instructions. They told him to be quiet. When i was in school my teachers told me to shut up. The teachers were frustrated with the child disobedience , they did not want him staring at the statue in library but read made some comments to the child that were harsh. End of story.
Everyone is on a witch hunt. The father has issues, the child has issues and the teachers have issues.
I don't care to hear any more about it. Let the teacher tell the father she was doing her best and she is sorry. End it move on

Yes I agree, but if you want to execute her you a name there would be no teachers left on the planet. i'm sure she took that job because she loves kids. She was upset and made a mistake , you want to kill her ?. I say lighten up. It's a tough tough job to babysit autistic kids. My friends have 2 autistic kids, they can get violent for no reason. They will attack other children and punch kick and bite because people like you are afraid to discipline them correctly. you need to look them in the eye and use a stern voice and say NO ... BAD. or they wont respect you. The father is lying when he said his kid is docile all the time. Autistic kids have no empathy for others and will cry attack and throw chairs knives break things and can be a nightmare. you would not last 5 minutes with my friends kids. The mom goes out and drinks every night after spending the day with them. i'll bet those teachers drink because of the stress of their job. They are probably crying right now

After listening to the youtube audio, it seems that the teacher was most definitely present while discussing what to tell the father in case he showed up on field day to explain her absence since she apparantly wanted to be paid for the day even though she wasn't going to show up, lmao. "Tell him I'm inside"
